Welcome to Moissanite Moe ("Moissanite Moe," "we," "our," or "us"). We're a U.S.-based jewelry brand and we currently ship only to addresses within the United States. This Policy is written primarily to comply with applicable U.S. federal and state law. We respect your privacy and are committed to protecting your personal data — this Policy explains how we collect, use, disclose, and safeguard your information when you visit our Site, interact with our marketing, or make a purchase.

We do not intend to offer goods or services to, or monitor the behavior of, individuals located in the EU, UK, or other regions outside the U.S., and we do not believe the EU or UK GDPR applies to our processing on that basis. If our business changes in a way that brings us into scope of those laws, we will update this Policy.

By using our Site, you acknowledge the data practices described in this Policy. If you do not agree, please do not use the Site.

We collect the following categories of personal information (using the categories defined under California's privacy law, since that framework is the most descriptive — this doesn't mean every category or right described below necessarily applies to our business; see Section 8):

About the government-ID category: We may collect government-issued ID for fraud prevention and identity verification only. We do not use it to infer characteristics about you and do not use it for advertising. Where applicable state law provides a right to limit use of sensitive personal information for other purposes, we will honor that right for any processing it covers.

We process personal data for the following business purposes:

• Processing, fulfilling, shipping, and confirming your orders.
• Providing customer support and order-related assistance.
• Screening orders for fraud, risk, and chargebacks.
• Marketing and advertising, including showing you relevant ads on social media and search platforms.
• Analytics and improving our Site, products, and customer experience.
• Sending transactional emails (order confirmations, shipping updates, returns).
• Sending marketing emails or SMS messages, where you have opted in.
• Complying with legal obligations, tax requirements, and law enforcement requests.
• Defending and exercising legal claims.

We track site activity and use advertising pixels. We use cookies, web beacons, software development kits (SDKs), and similar tracking tools, including:

• Strictly necessary cookies — required for the Site to function (cart, checkout, login).
• Analytics cookies — Google Analytics.
• Advertising cookies and pixels — Meta (Facebook/Instagram) Pixel, including server-side Conversions API, and any other ad-platform pixels we actively use (see Section 6 for the current list).

What advertising pixels share: When you visit the Site, these tools may transmit page-view events, button clicks, add-to-cart events, checkout events, purchase amounts, and hashed identifiers (such as a hashed version of your email) to the relevant ad platform. This transmission may qualify as "sharing" or a "sale" of personal information under some state privacy laws. See our Notice at Collection for a short-form summary at the point we collect your information.

Your cookie choices:

• Cookie banner: When you first visit the Site, you'll see a cookie banner allowing you to accept or reject non-essential cookies. You can change your preferences anytime via "Cookie Settings" in the Site footer.
• Global Privacy Control (GPC): Where required by applicable state law, we honor opt-out preference signals sent by browser-based GPC settings as a valid opt-out of "sale" and "sharing." This is implemented through our platform's consent tools — see Section 8.
• Browser controls: You may also adjust your browser settings to refuse cookies, but Site functionality may be affected.
• Ad platform opt-outs: You can opt out of interest-based ads from Meta at facebook.com/settings/?tab=ads and from Google at adssettings.google.com.

Do Not Track: Our Site does not currently respond to browser DNT signals, as there is no industry standard for them. This doesn't affect our handling of legally recognized signals such as GPC, described above.

Email: If you opt in to marketing emails (or by purchasing from us, where permitted by applicable law and our checkout disclosure), we may send you promotional emails. Every marketing email contains an unsubscribe link and our required physical mailing address, and you may also email moissanitemoe@gmail.com with the subject "Unsubscribe." We aim to comply with the CAN-SPAM Act.

SMS/Text messages: If you opt in to SMS marketing by providing your mobile number and affirmatively consenting (e.g., checking a checkbox or texting a keyword), we may send recurring marketing texts. Message and data rates may apply. Message frequency varies. Consent is not a condition of purchase. Reply STOP to cancel or HELP for help. This Policy describes how we use the data collected through SMS opt-in; the actual consent to receive texts is collected separately, through the specific opt-in language and checkbox shown at signup. We aim to comply with the Telephone Consumer Protection Act (TCPA).

We do not sell your personal data for money. We share personal data only with vendors we actually use, currently including:

• E-commerce platform: Shopify Inc. (storefront hosting, checkout, payment processing)
• Payment processors: Shopify Payments and/or PayPal (full card data handled directly by them)
• Shipping carriers: USPS, UPS, FedEx, and other U.S. carriers
• Fraud prevention services: Shopify Fraud Protect and similar risk-screening tools built into our platform
• Marketing and analytics providers: Google (Analytics, Ads) and Meta (Pixel, Conversions API, Business Suite)
• Professional advisors: Lawyers, accountants, and auditors, under confidentiality obligations
• Government and law enforcement: Where required by subpoena, court order, or other legal process
• Successor entities: In the event of a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business, personal data may be transferred to the successor entity, subject to the same protections in this Policy

Some of these providers act as our service providers, processing data on our behalf. Others — including Meta and Google, with respect to their own advertising products — may independently determine how they use certain data for their own purposes; their own privacy policies describe that use.

"Sale" and "Sharing" under state law: Our use of advertising pixels (such as the Meta Pixel) for cross-context behavioral advertising may qualify as a "sale" or "sharing" of personal information under some state privacy laws. Where that applies to us, you have the right to opt out — see Section 8.

We keep personal data for as long as reasonably necessary for the purposes described in this Policy, including legal, tax, accounting, security, fraud-prevention, and dispute-resolution obligations. As a general guide, our current targets are:

• Order and transaction data: around 7 years (tax and accounting)
• Account and customer profile data: while your account is active, plus a few years after last activity
• Identity verification, if collected: handled under our verification provider's own retention schedule — we don't separately store ID images
• Marketing email/SMS subscriber data: until you unsubscribe or request deletion
• Customer support correspondence: a few years after resolution
• Cookie, tracking, and device/log data: up to about 24 months

These are targets across the systems we use (Shopify, our analytics, and email/SMS tools), not guarantees down to the day — actual timelines can depend on our vendors' own retention settings.

Depending on your state of residence, and whether an applicable state privacy law covers our business, you may have some or all of the following rights. Thresholds, exemptions, and exact rights vary by state:

• Access / Right to Know — request a copy of the personal data we hold about you
• Correction — request correction of inaccurate data
• Deletion — request deletion of your personal data, subject to legal retention requirements
• Portability — receive your data in a portable, machine-readable format
• Opt-out of Sale / Sharing / Targeted Advertising — opt out of our use of pixels and similar tools for cross-context behavioral advertising
• Limit Use of Sensitive Personal Information — where applicable, limit our use of SPI (such as government ID) to the purposes necessary to provide the goods or services you requested
• Automated decision-making / profiling — where required by applicable law, you may have rights regarding certain automated decisionmaking or profiling
• Non-discrimination — we will not discriminate against you for exercising your rights
• Appeal — where applicable law provides an appeal right, you may appeal our denial of a privacy request using the instructions in our response to you

We implement commercially reasonable technical, administrative, and organizational safeguards designed to protect your personal data against unauthorized access, loss, misuse, or disclosure. These include encryption in transit (TLS), restricted access controls, vendor due diligence, and payment processors that maintain their own PCI-DSS compliance.

No method of transmission over the internet is 100% secure. If we experience a data security incident requiring notification under applicable law, we will provide notice as required by that law.

Our Site and products are intended for adults. We do not knowingly collect personal data from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA).

We do not knowingly accept purchases from individuals under 18 without verified parental consent. If you believe we have inadvertently collected data from a minor, contact us at moissanitemoe@gmail.com and we will delete the information. We don't rely on this paragraph alone as an age-verification system if we have specific reason to believe minors are using the Site.

Our Site may contain links to third-party websites, services, or social media platforms. We are not responsible for the privacy practices of those third parties. Please review their privacy policies before providing them with your information.

We may update this Privacy Policy from time to time. We'll post the revised Policy here with a new "Effective Date." For material changes, we'll provide additional notice — such as an email to subscribers or a Site banner — at least 30 days before the change takes effect where required by law. Continued use of the Site after the effective date means you accept the revised Policy.

When you give us your email, phone number, or other personal information — for example, at checkout, when creating an account, or by signing up for emails or texts — we collect identifiers, order/commercial information, and browsing activity to fulfill your order, provide support, prevent fraud, and, where you've agreed, send marketing and show you relevant ads. Showing relevant ads may involve sharing hashed identifiers with ad platforms like Meta and Google, which some state laws treat as a "sale" or "share" of personal information. We keep this information only as long as reasonably necessary for these purposes (see Section 7). Use Your Privacy Choices to opt out of targeted advertising.

Moissanite Moe is a U.S.-based jewelry brand shipping to addresses within the United States only. By accessing or shopping at Moissanite Moe, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Site or purchase our products.

You must be at least 18 years of age (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to make a purchase. We may update these Terms at any time; material changes will be posted here with a new Effective Date, and continued use of the Site after that date means you accept the revised Terms. Nothing in these Terms limits any right or remedy you have under applicable law that cannot lawfully be excluded by agreement.

By using the Site or making a purchase, you consent to receive transactional and service-related communications from us electronically (order confirmations, shipping updates, account notices) and agree that these electronic communications satisfy any legal requirement that they be in writing, consistent with the federal E-SIGN Act. Marketing communications are sent only where permitted by applicable law and, where required, with your separate opt-in consent (see Privacy Policy, Section 5).

We make every effort to display the colors, dimensions, and details of our jewelry accurately. Because metal reflections and stone brilliance depend on lighting, photography, product renderings, and your device screen, we can't guarantee perfect color/detail accuracy on your screen. Product descriptions are provided in good faith but don't constitute express warranties unless explicitly stated.

3.1 AI-Generated & Enhanced Imagery

Some images on the Site and in our marketing (including social ads) are AI-generated or AI-enhanced. We use this kind of imagery mainly for lifestyle, styling, and atmosphere — not to depict exact specifications. Actual product characteristics (stone count, stone size, setting, metal finish, etc.) are shown through real product photography and written descriptions on each product page, and those control over any stylized or AI-rendered image. We do not use AI imagery in a way that shows a materially different stone size, count, or setting than what you'll actually receive. Want more real photos or video of a piece before ordering? 3.2 Metal Disclosure — Gold Plated, Not Solid Gold

Our jewelry is made from 925 sterling silver plated (electroplated) with genuine gold — never a gold-colored imitation metal. We describe this plainly as "925 Sterling Silver — Gold Plated" in product titles and on every product page, consistent with the FTC Guides for the Jewelry, Precious Metals, and Pewter Industries (16 C.F.R. Part 23). This is not solid gold or gold-filled. We describe each product according to its actual metal composition and plating rather than using the word "gold" on its own — this terminology is used consistently across our product titles, ad creative, and social captions, not only here. Gold plating can wear with regular use, moisture, lotions, and perfume exposure; we recommend removing jewelry before swimming, showering, or exercising.

3.3 Moissanite Stone Disclosure

The stones in our jewelry are moissanite — a lab-created gemstone, chemically and visually distinct from a diamond. We identify our stones as "moissanite" throughout the Site and our marketing and never describe them as diamonds. Some thermal diamond-testing devices may register moissanite as diamond because moissanite has thermal conductivity similar to diamond — that is a factual property of the material, not a representation that the stone is a diamond, and we do not market our products as "passing" a diamond test in a way implying they are diamonds.

3.4 Customer Reviews

Reviews and testimonials on the Site reflect genuine customer experiences. We do not buy, fabricate, or generate fake reviews, and we do not condition discounts or incentives on a reviewer leaving positive feedback. If we ever provide free or discounted product in exchange for a review, that relationship will be disclosed as required by the FTC's rules on reviews and testimonials.

• Currency: All prices are listed in U.S. Dollars.
• Pricing errors: Prices and product information are subject to change without notice. In the event of an obvious pricing error or typo, Moissanite Moe reserves the right to cancel the affected order (with a full refund) even after order confirmation.
• Taxes: Sales tax is calculated and added at checkout based on the shipping address and applicable law.
• Payment: We accept payment methods listed at checkout. You represent that any payment method you use is yours or that you're authorized to use it.

Custom jewelry: If offered, custom-designed pieces, personalized engravings, and special-order items are subject to separate design approval and are final sale once production begins, except where the item is defective or materially misrepresented.

Sizing: It's the customer's responsibility to provide accurate sizing where applicable. Moissanite Moe isn't liable for fit issues caused by incorrect sizing the customer provided.

We currently ship only to addresses within the United States. We only advertise shipping or delivery timeframes (e.g., "ships in 2 business days") that we have a reasonable basis to meet. Where we don't specify a timeframe, we aim to ship within 30 days, consistent with the FTC's Mail, Internet, or Telephone Order Merchandise Rule.

If a shipment will be delayed beyond what we advertised (or beyond 30 days, if no timeframe was given), we'll notify you and offer the choice to consent to the delay, or cancel for a full refund. Nothing in this section limits any right or remedy you have under applicable law.

• Risk of loss: Title and risk of loss pass to you upon delivery by the carrier to the shipping address you provided.
• Signature required: We reserve the right to require an adult signature upon delivery for certain orders.
• Delivery confirmation: Once a package is marked "Delivered" by the carrier (with any required signature confirmed), we're not liable for packages lost or stolen after that point, though we'll always work with you on carrier claims.
• Delays outside our control: We're not responsible for carrier delays, weather, acts of nature, or other events outside our reasonable control — the notice-and-refund process above still applies where legally required.
• Insurance: Shipments may be insured at our discretion; details are provided in your order confirmation.

Standard items: 15-day return window for unworn, unaltered items in original packaging with all original tags and any included documentation, starting from the delivery date.

Initiating returns: Email moissanitemoe@gmail.com within 15 days for a Return Merchandise Authorization (RMA). Unauthorized returns won't be accepted.

Return shipping: Customer pays return shipping on standard (non-defective) returns. Defective or incorrect items get a prepaid return label from us.

Refund timeline: Approved refunds are processed within 10 business days of receiving and inspecting the returned item, back to the original payment method — our internal target, not a limit on any faster timeline required by your card network or applicable law.

Final-sale items: All sales are final on custom-made, engraved, resized, or otherwise modified items, unless the item is defective or materially differs from its description.

Defective items: Contact us within 15 days of delivery for a replacement, repair, or refund. Nothing in this policy limits any right or remedy you have under applicable law.

If you create a customer account, you agree to provide accurate and complete information, keep your password confidential, take responsibility for activity under your account, and notify us immediately at moissanitemoe@gmail.com of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

You agree not to use the Site for any unlawful, fraudulent, or harmful purpose; reverse engineer, scrape, or attempt to access non-public areas; use bots/scrapers/spiders without permission; or submit false, misleading, or fraudulent orders.

If you submit reviews, photos, comments, or other content ("User Content") to the Site or our social channels, you grant Moissanite Moe a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that User Content to operate, display, and promote our business — including on our Site, social media, and ads. You can ask us to stop using specific User Content by emailing moissanitemoe@gmail.com; we'll honor that going forward, though we may not be able to recall content already distributed by third-party platforms. By submitting User Content, you confirm you have the right to share it, including the right to depict anyone else who appears in it.

All content on the Site — product images, designs, descriptions, logos, trademarks, and branding — is the property of Moissanite Moe or its licensors and is protected by intellectual property laws.

Copyright concerns: If you believe content on the Site infringes your copyright, email moissanitemoe@gmail.com with a description of the work, its location on our Site, and your contact information, and we'll review and address it.

We may refuse, cancel, or hold any order we suspect is fraudulent, unauthorized, or unlawful. If an order triggers a high-risk fraud alert, we may cancel and refund within 5–7 business days, or ask you to complete identity verification through our third-party verification provider before shipping. We don't collect or store government-issued ID images ourselves.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. MOISSANITE MOE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOISSANITE MOE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. MOISSANITE MOE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless Moissanite Moe and its owners, officers, employees, agents, and affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms.

15.1 Informal Resolution: Before filing any arbitration, send a written Notice of Dispute to moissanitemoe@gmail.com and attempt in good faith to resolve it for at least 30 days.

15.2 Binding Individual Arbitration: If informal resolution fails, disputes are resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Cook County, Illinois.

15.3 Class Action and Jury Trial Waiver: YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

15.4 Mass Arbitration: Coordinated filings of 25 or more similar claims follow AAA's Mass Arbitration Supplementary Rules batching procedures.

15.5 30-Day Opt-Out: You may opt out of this arbitration agreement by emailing us within 30 days of the date you first create an account or place an order with us, whichever happens first.

16. Governing Law: Illinois law governs these Terms. Disputes not subject to arbitration are heard in Cook County, Illinois.

17. Accessibility: We strive to conform to WCAG 2.1 Level AA standards. Contact moissanitemoe@gmail.com if you face barriers.

18. Promos & Gift Cards: Codes are limited to one per order, non-transferable, and can't be redeemed for cash.

19. Force Majeure: Neither party is liable for failures or delays caused by acts of God, pandemics, or supply chain disruptions outside reasonable control.

20. Entire Agreement: These Terms are the entire agreement between you and Moissanite Moe and are severable if a court finds any part invalid.
